The Wright Event – Client Terms and Conditions (Leisure Bookings)
These are the standard terms of Client Business of The Ian Wright Organisation (IWO), of Ashtree Farm, Teston Road, West Malling, Kent ME19 5RL and all activities undertaken by IWO shall be on these terms unless specifically varied in writing and agreed to by both parties prior to the event.
1. Activity Booking Details
1.1 Provisional bookings for activities will not be accepted and bookings will not be confirmed until a minimum of a 50% non-refundable deposit for the required services has been received (as set out in Clause 2.4 below).
1.2 Guaranteed final minimum numbers are required 10 working days prior to the start of the event. For the purpose of these terms and conditions working days shall mean Monday to Friday inclusive.
1.3 The client may not, without the prior written agreement of IWO bring any food, drinks, drugs or spirits into the venue for use or consumption during an event.
1.4 IWO retain the right to charge for any non-attendees at full price. Should there be any increase in numbers to those booked full payment will be required prior to taking part in the activity. There is however no guarantee that spaces will be available for late bookings.
1.5 IWO operates a minimum age policy. It is strictly the responsibility of the representative of the client confirming the booking to inform all interested parties of the ages of the participants.
2. Price & Payment
2.1 All prices quoted by IWO may be amended at any time where an increase is caused by a change in the circumstances beyond the reasonable control of IWO. Clients should check the price of their activity at the time of booking.
2.2 Any query arising from an invoice must be notified to IWO in writing by the Client within 10 working days of the invoice date. Failure to comply will render the full invoice payable on the due date.
2.3 It is strictly the responsibility of the representative of the Client confirming the booking to inform all interested parties of the payment terms, as set out by IWO.
2.4 Deposit – A deposit of 50% of the total fee payable (including VAT) of any event or programme shall be payable on confirmation of the order. The remaining 50% shall be known as the “balance”.
2.5 Balance Due – the balance of the total fee shall be payable 10 working days prior to the event date.
2.6 Late Bookings – Should a booking be made within 10 working days of the event date, payment in full will be required to secure the event.
2.7 Methods of Payment:
Payments are to be made by credit or debit card.

The Client must inform IWO in writing (preferably by e-mail) of any bank transfers
All major credit cards are accepted, but please note that Credit Card payments will be subject to a 2.0% handling fee
3.1 Requests by clients for a postponement of their event must be received more than 5 working days prior to the date of the session.
3.2 If notice of postponement is received 5 working days or less prior to the date of the session all deposits, payments or gift vouchers are forfeited.
3.3 All bookings postponed due to adverse weather conditions or because of some other event reasonably beyond our control, will be re-arranged to an alternative date. The session will not be eligible for any refund.
3.4 Where an activity has been postponed by ‘IWO’, IWO will endeavour to notify participants as soon as possible. However, occasionally the need for IWO to postpone the event may come at very short notice due to weather or other circumstances beyond the control of ‘IWO’ and its suppliers. In these instances no reimbursement or compensation of travel or incurred costs will be awarded by ‘IWO’ to those participants.
3.5 In the event of adverse weather conditions or mechanical failure or damage to equipment, IWO reserves the right to substitute activities for reasonable alternatives.
3.6 IWO reserves the right to change or alter the dates, times or the format of scheduled sessions without prior notice or consultation.
4. Gift Vouchers
4.1 Vouchers are non-refundable
4.2 Gift vouchers cannot be exchanged for cash or used as part payment of any credit account.
4.3 No credit or cash value will be given if the voucher is redeemed for an activity of less than face value.
4.4 Validity – IWO Gift vouchers have a valid to date. If not redeemed within this period the voucher will automatically become invalid, forfeiting the bearer any right to participate in activities.
4.5 IWO Vouchers can be extended for a further 6 months after the expiry date. This is subject to the following conditions:
4.5.1 Vouchers must be extended before the initial expiry date shown.
4.5.2. An administration charge of £20 + VAT per voucher will be payable on extension.
4.5.3. Please note that special offer vouchers cannot be extended.
4.6 IWO regrets that any lost, mislaid, damaged or stolen vouchers cannot be replaced. The voucher will be deemed invalid if altered or tampered with in any way.
4.7 Upgrades – On payment of any price difference, the bearer may upgrade the voucher to an extended or alternative experience, upgrades must be approved and agreed with The Ian Wright Organisation prior to booking a session.
5.1. The activities that Clients will undertake are inherently dangerous although all guests are fully supervised throughout. As such neither IWO or its employees or agents shall be liable for any damage, loss, delay or expenses caused to the client, its employees, agents, licensees or invitees or any other persons attending the event except insofar as it results from the proven negligence of IWO. IWO’s liability shall in all cases (individual personal injury excepted) be limited to the sums paid by the client and shall exclude indirect or consequential loss of whatsoever nature. Individuals are required to sign a liability waiver on the day of the event (although the same does not purport to exclude liability for personal injury arising as a result of the proven negligence of IWO).
6. Events outside our control
6.1. IWO shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery, and IWO shall be entitled to a reasonable extension of its obligations.
7.1. If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.
8. Governing Law
8.1. These Terms and Conditions shall be governed by and construed inaccordance with the law of England and the parties submit to the exclusive jurisdiction of the English courts.
9. Entire Agreement
9.1. This Agreement contains the entire agreement between the parties relating to the subject matter and supersedes any previous agreements, arrangements, undertakings or proposals, oral or written. Unless expressly provided elsewhere in this Agreement, this Agreement may be varied only by a document signed by both parties.
